ICLSP Team Participates in INCLAR 2024 Conference at UMM
On July 22–23, 2024, ICLSP representatives Ahmad Sabirin and Fuad Muhamad Fahrudin participated in the International Conference of Law Reform (INCLAR) 2024 held at the Faculty of Law, University of Muhammadiyah Malang.
During the conference, our team presented three papers addressing critical issues in law and policy reform in Indonesia:
- Building the National Capital City: Are There Allegations of Monopolistic Practices?
This paper critically examines the development of Indonesia’s new capital city (IKN) through the lens of competition law. We argue that the joint ventures involved in the project may potentially lead to monopolistic practices that undermine fair business competition. -
Tracing the Labyrinth: Unraveling the Puzzle of Financial Dispute Resolution in Indonesia
This paper proposes the reformulation of Article 29(c) of the Financial Services Authority Law. Our recommendation is to revise the clause from merely allowing facilitation of dispute resolution to enabling the Financial Services Authority (OJK) to establish a dedicated Financial Services Dispute Resolution Institution (LAPS). We also emphasize the importance of harmonizing this with related financial sector regulations. -
Interest Rights and Forest Management: Perspectives on the Conflict between Government and Indigenous Peoples’ Rights
In this paper, we explore the ongoing tensions between state forest management policies and indigenous land rights. Our findings highlight the urgent need for clearer regulations and policies that recognize and protect indigenous communities’ customary rights to forest resources.
